It's hard to say whether he is dead or not. He left Tim with something that sounded like a last Will and Testament, according to Allen, anyway.
Just because he wasn't in the room when the second guard checked, doesn't mean that he was alive. Like Komui and the others discussed, the glass could've broke under his weight from his body leaning against it.
Also, the fact that the Innocence in the Judgement no longer responds to Cross might mean something. The second Innocence wasn't mentioned, so it's somewhat of a mystery. So he's either alive, or he's dead and his Innocence is still responding to him. Is it possible that the Heart is his second Innocence? It's not confirmed that either Allen or Lenalee has the heart.
Maybe he was assasinated? He knew a lot more than he should have, and since they were listening in on his and Allen's conversation... But, that doesn't make much sense that Cross was assasinated. If Cross were assasinated that easily, then the Black Order is definitely screwed. ._.;;
Or maybe did he did kill himself? There were gunshot holes in the window. He seemed to care more about Allen than he let on. Perhaps he thought of him as some sort of family? Was Allen his only disciple, though? Anywho, he seemed more emotional than the Cross we're all used to when he was explaining about the Fourteenth to Allen. Maybe he thought that there'd be no hope and that he'd have to do some nasty deed that he didn't want to do if worst came to worst and couldn't bear it? Though, that doesn't sound very Cross-ish. But Cross didn't seem very Cross-ish in that chapter anyhow... :/
Though, I'm not saying he's dead. It actually sounds like some sort of ruse he'd create so people wouldn't bother him any more. He never seemed fond of being an Exorcist.
